These terms govern your use of FoundryOS. By signing up, you agree to them as described below.
You must provide accurate, complete information when creating a FoundryOS account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
FoundryOS is intended for legitimate field service businesses (HVAC, plumbing, electrical) with 1–30 technicians. Accounts created with false or misleading business information may be suspended or terminated without notice.
You must be authorized to bind your business to these terms. If you are signing up on behalf of a company, you represent that you have the authority to do so.
FoundryOS offers four pricing tiers: Solo ($99/mo, 1–2 techs), Starter ($299/mo, 3–10 techs), Growth ($599/mo, 11–20 techs), and Scale ($799/mo, 21–30 techs).
All plans begin with a 14-day free trial. After the trial period, you are billed monthly at the rate corresponding to your selected plan. Charges recur on the same day of each subsequent month (or the closest available date for months with fewer days).
You authorize FoundryOS to charge your payment method on file for all subscription fees and applicable overage charges. All fees are non-refundable except as required by applicable law.
Failed payments may result in account suspension until the outstanding balance is resolved. We reserve the right to remove inactive accounts from our servers after 60 days of non-payment.
We may change pricing at any time. Changes to pricing take effect at the start of your next billing cycle after notice is provided (email or in-app notification).
Each pricing tier includes a monthly SMS allowance:
Messages sent beyond the monthly cap are billed as overages. Overage rates are: Solo $0.008/msg, Starter $0.006/msg, Growth $0.005/msg, Scale $0.005/msg. Overage charges are added to your next monthly invoice.
SMS usage resets on the 1st of each calendar month. Unused message allowance does not carry forward.
You are responsible for ensuring your use of SMS notifications complies with applicable law, including CAN-SPAM, TCPA, and state-specific messaging regulations. FoundryOS provides the sending infrastructure; compliance responsibility rests with the account holder.
You retain full ownership of all data you input into FoundryOS, including customer names, addresses, job records, and technician information.
FoundryOS does not claim ownership of your data. We do not sell, license, or share your customer data with third parties for marketing or advertising purposes.
We may use aggregated, anonymized operational data (e.g., average job completion times across all customers) to improve our services and AI scheduling algorithms. This data cannot be traced back to your account.
If your account is terminated, we will make your data available for export for 30 days following termination. After that period, data is deleted from our systems in accordance with our standard data retention schedule.
You agree not to use FoundryOS to:
Violations may result in immediate account suspension or termination without refund.
You may cancel your FoundryOS subscription at any time from the Settings page. Cancellation takes effect at the end of your current paid billing period. No prorated refunds are provided for mid-cycle cancellations.
We may suspend or terminate your account at our discretion if you violate these terms, fail to pay, or engage in activity we reasonably believe to be fraudulent or harmful to other users.
Upon termination, your access to the service ends immediately. We may retain your data for up to 30 days as described in Section 4.
FOUNDRYOS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE UPTIME, AVAILABILITY, OR ERROR-FREE OPERATION. THE AI SCHEDULING RECOMMENDATIONS ARE ADVISORY ONLY — YOUR DISPATCHER RETAINS FINAL AUTHORITY OVER ALL JOB ASSIGNMENTS.
IN NO EVENT SHALL FOUNDRYOS, ITS AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF FOUNDRYOS SHALL NOT EXCEED THE TOTAL FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
These terms are governed by the laws of the United States. Any dispute arising from your use of FoundryOS that cannot be resolved informally between you and our team shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English, and held in the jurisdiction where FoundryOS is headquartered.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FoundryOS.
If any portion of these terms is found unenforceable, the remainder continues in full effect.
